This Privacy Policy explains how Martinexsa USA, LLC (“Martinexsa USA,” “we,” “us”) collects, uses and shares personal information when you visit martinexsa-usa.com (the “Site”), fill out one of our forms, or otherwise contact us. It also explains the choices and rights you have.

1. Information we collect

Information you give us. When you fill out a form on the Site (for example, to request a conversation, design a team, or download our talent catalog) we collect what you enter, which may include:

• Your name, work email address, company and job title.
• Your phone number, if you choose to provide it.
• Details about your needs, such as the role you want to fill, technology stack, timeline, team context or project description, and any message you send us.

Information collected automatically. When you use the Site we and our service providers collect technical and usage information, such as your browser and device type, IP address, pages viewed, the website that referred you, and the time of your visit. If you arrive from an ad or a link with campaign parameters (for example, UTM parameters or advertising click identifiers), we record those parameters so we know which campaign or channel brought you to us. Your browser keeps this campaign information for up to 90 days and sends it to us only together with a form you submit.

2. Cookies and similar technologies

We use cookies and similar technologies to operate and secure the Site, remember your cookie choice, understand how the Site is used and, if you allow it, measure our advertising. When you first visit, a cookie banner lets you accept or decline non-essential cookies. Analytics and advertising tags only use cookies after you accept them, and you can change your choice at any time with the “Cookie settings” link at the bottom of every page. Your choice is stored in your browser and we ask again after 12 months.

• Strictly necessary and security: Cloudflare, which hosts the Site and protects our forms against spam and abuse (Cloudflare Turnstile).
• Analytics: Google Analytics and Microsoft Clarity, managed through Google Tag Manager, to understand visits and how our pages perform. Clarity records how visitors scroll and click (anonymous session replays and heatmaps); text typed into forms is masked.
• Advertising: we may use advertising tags (such as Google Ads, Meta or LinkedIn) to measure whether our ads lead to inquiries. These run only if you accept advertising cookies.

3. How we use your information

• To respond to your request, contact you and schedule a conversation.
• To understand the role or project you describe, search for and evaluate candidates, and share candidate profiles and evaluation reports with you.
• To send you materials you request, such as our talent catalog or a team recommendation.
• To generate a suggested team composition when you use our Build Your Team tool, which uses an artificial intelligence service to process the information you enter.
• To manage our business relationship with you in our customer relationship management (CRM) systems.
• To measure which channels and campaigns bring inquiries, and to improve the Site and our services.
• To protect the Site, prevent fraud and spam, and comply with legal obligations.

4. How we share your information

We do not sell your personal information. We share it only with service providers that help us run our business and process it on our behalf, including:

• Hosting, database and security: Cloudflare and Supabase.
• Customer relationship management: Pipedrive.
• Scheduling and video calls, if you book a call with us: Microsoft (Bookings and Teams).
• Analytics and tag management: Google and Microsoft (Clarity).
• Email delivery: our email delivery provider.
• Artificial intelligence processing for the Build Your Team tool.

We may also disclose information to our affiliated Martinexsa companies that support recruitment and delivery, to professional advisers, if required by law or legal process, to protect our rights and users, or as part of a merger, acquisition or sale of assets.

5. How long we keep information

We keep personal information for as long as needed for the purposes described above, including maintaining our business relationship with you, and as required by law. When it is no longer needed, we delete or anonymize it.

6. Your choices and rights

Depending on where you live, you may have the right to request access to the personal information we hold about you, ask us to correct or delete it, obtain a copy of it, or opt out of certain uses, including targeted advertising. You can also unsubscribe from marketing emails at any time using the link in the email.

To make a request, email hello@martinexsa-usa.com. We will verify your request and respond within the time required by applicable law (generally within 45 days). You may use an authorized agent to make a request on your behalf. We will not discriminate against you for exercising your rights.

7. International transfers

We are based in the United States and work with a talent network across Latin America. Your information may be processed in the United States and in other countries where we, our affiliates or our service providers operate. We take steps to protect it wherever it is processed.

8. Security

We use reasonable administrative, technical and physical safeguards to protect personal information, including encrypted connections, access controls and bot protection on our forms. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

9. Children

The Site is intended for businesses and is not directed to children under 16. We do not knowingly collect personal information from children.

10. Changes to this policy

We may update this Privacy Policy from time to time. We will post the updated version on this page and change the “Last updated” date above.
